A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks lawful basis.

"Since his release after wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.

The case originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. Following his return to the United States to face human smuggling charges, he was held in immigration custody.

In her decision, the court noted that the authorities does not have a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The legal challenge center on conflicting assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this claim.

He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing trial in the state of Tennessee.

The judge, who was hearing his challenge to removal in a Maryland district court, ruled that he must now adhere to the conditions of his release from jail in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
